July 6, 1998 The meeting was called to order by president, Gene Seiman. Members present were Mike Grill, Mark Workman, Gene Seiman and Carol Schuler. Dick Leaf, Building Commissioner was also present. The minutes of the June 1, 1998, meeting were reviewed. Mark Workman moved that we accept the minutes as presented. Mike Grill seconded the motion. The motion was approved. We discussed the 98-4 case regarding Sue Elrods improvements that are needed. Case 98-5 regarding Jay Encks request was reviewed. Mark Workman moved that we accept the variance as presented with the restriction on the deed that allows that while the Encks own the home it can remain as a duplex. Variance is to be reviewed upon the sale of property. Mike Grill seconded the motion. It was approved. Old Business Dick Leaf will call Diane Bauder and see if she wants to extend the variance for a Grace College student to live at her house for another year. Pill Box garage There were questions regarding oxygen stored in the garage. The question came from a Winona Lake resident who was not on the B.Z.A. committee. Dick Leaf will check on the oxygen storage, if it is not stored according to the state regulations, and the number of trucks coming into the garage area. June 1, 1998 The meeting was called to order by president, Gene Seiman. Members present were Dane Miller, Mike Grill, Gene Seiman, and Carol Schuler. Dick Leaf, Building Commissioner was not present. Minutes from the May 18, 1998 meeting were read. Dane Miller moved and Mike Grill seconded the motion to approve the minutes as read. Motion passed. Case 98-4 Gene Seiman read a letter from Dick Leaf regarding the follow-up meeting. Several concerns were mentioned. Kim Endicott had concerns regarding sewer. Malcolm Gilbert had concerns regarding backing out on Wooster Rd. Committee members suggested that the traffic entrance for 405 be from the alley with exit using the private drive at 411 Wooster Rd. Dane Miller moved that the variance be accepted as presented with the exception of single direction traffic pattern and modification of the driveway be approved by the building commissioner. Mike Grill seconded the motion. Motion approved. May 18, 1998 The meeting was called to order by president, Gene Seiman. Members present were Dane Miller, Mike Grill, Mark Workman, and Carol Schuler. Dick Leaf, Building Commissioner was also present. Minutes from the April 20, 1998 meeting were read. Dane Miller moved and Mike Grill seconded the motion to approve the minutes as read. Motion passed. Case 98-3 Mr. and Mrs. Haney requested a variance to replace an existing barn with a new larger barn. The barn would be 2 feet above the height requirement but lower than the existing barn. It would be built on the existing foundation. It would be used for storage only. Mike Grill moved and Dane Miller seconded the motion that we accept the variance as presented. Motion approved. Case 98-4 Richard Helm presented the variance for Sue Elrod for the use of two residential homes to be used as a daycare center. There would be a maximum of 24 children at each home, 12 people per floor. E.J. Underwood from Grace Schools had concerns with increased traffic and student drivers from the school. Billie Emslie wrote voicing their disapproval of the variance. It was moved and seconded that we table the variance for additional information on safety and traffic concerns. We are asking for outside help with the concerns. A meeting with Larry Long, Kim Endicott, Malcolm Gilbert and some members of the BZA will be set up by Dick Leaf as soon as possible. Motion carried. Members present were Dane Miller, Mike Grill and Carol Schuler. Dick Leaf, Building Commissioner was also present Minutes from the February 23, 1998 meeting were read. Mike Grill moved and Carol Schuler seconded the motion to approve the minutes as read. Motion passed. Case 98-2 Leigh Utter requested a variance for property at 225 S. Union to erect a 16 x 24 attached garage. Garage would be approximately 1.2 ft. from property line. Dane Miller moved and Mike Grill seconded the motion to approve the variance. Motion passed. Case 98-3 Richard Flora requested a variance for an 18x I 0 addition on the back of his home at 1105 Court St. Addition would be placed on the back of his house after the removal of a 6x8 ft bathroom. This addition would result in more than the allowable percentage of the lot to be covered by the house. Mike Grill moved and Dane Miller seconded the motion to approve this variance. Motion passed. Case 98-4 J. Davis Illingworth has requested a variance for property at 112 Ft. Wayne St. A new house is to be built replacing a house that was removed 2/97. House will be 1 1/2stories, 1638 sq. ft. Variance is requested because house would not meet present setback codes- Dane Miller moved and Mike Grill seconded the motion to accept the variance. Motion passed. Next meeting is May 18, 1998. Meeting was adjourned at 7:30 p.m. February 23, 1998 The meeting was called to order by acting president, Mark Workman.Members present were Mark Workman, Mike Grill and Carol Schuler. Dick Leaf, Building Commissioner was also present. Minutes from the September 24, 1997 meeting were approved by common consent. Case 98-1 William and Lynette Whittaker requested a variance to an addition to an existing horse barn on 250E. The height of the addition will be 18 feet. Attorney Lee Heyde asked that the following restrictions be included on the variance.
